Buyer OR Customer refers to you the purchaser of any Item(s)/Products(s) sold by Leafgreen Solutions LLC.

SELLER refers to Leafgreen Solutions LLC.

MAILING LIST/REVIEWS

When you purchase a product from our site/shops, you’ll receive an email asking for a review of how we did, and how the item worked for you. This tells us how we’re doing, and helps others know how we have served past clients.

We will never sell or give out your info to others, however we do ask that by agreeing to these Terms & Conditions you are allowing us to send you these friendly emails for reviews and our mailing list. You can unsubscribe at anytime for any reason.

GENERAL

These Terms and Conditions of Sale and any attachments govern the sale of products purchased hereunder prevail over any conflicting or inconsistent terms and conditions appearing on any purchase submitted by the buyer. No change or modification of these Terms and Conditions shall be valid or binding on either party unless in writing and signed by an authorized representative of each party, as part of or modification to the quotation.

DELIVERY

Leafgreen Solutions LLC ships items via USPS Ground Advantaged mail with delivery tracking and shipping times ranging from 2 – 10 days from time of sale. Leafgreen Solutions LLC is responsible for your items well-being until delivery tracking number shows product delivered to shipping address provided by buyer at time of sale. Once Tracking number shows delivered, Leafgreen Solutions LLC is no longer responsible for items safe transport/handling.

During times of heavy shipping volume, your package delivery can take up to 30 days by the shipping carrier. Leafgreen Solutions cannot help the speed at which carriers operate or their inefficiencies. We understand you may need a solution quickly and choose not to want the item/product once received. You may return the item minus shipping within our 30 day return period.

DAMAGE AND SHORT SHIPMENT

In the event items are received damaged, keep all packaging material and contact Leafgreen Solutions LLC in writing within THREE business days of delivery. In the event packaging is damaged, the buyer MUST include photos showing damage to packaging and item(s)/product(s). Leafgreen Solutions LLC will resolve the issue with the carrier or you the buyer within 30 business days.

PRICES, TAXES, AND PAYMENT

All prices are per item (except where indicated) are in US dollars. All prices are subject to change without notice. Taxes, such as Federal, State, or local, which is the obligation of Leafgreen Solutions LLC to collect in connection with the sale or delivery of products described on any attachment shall be paid by buyer and will appear as separate items on the invoice.

RETURNS

Leafgreen Solutions LLC has a 100% satisfaction guarantee for 30 days after shipping Tracking Number shows delivered or physical pick up of product(s)/item(s). If for any reason you want to return your item(s), you can request a return. Returned items after 30 days are not allowed. Returned items must be clean, and remain in new condition as you received the item(s). If items are not in a re-sellable condition, a re-stocking fee of up to 50% of the item sale price may be applied. (See Re-Stocking Section below for more info.) Proper packaging for shipping will be the responsibility of the buyer for any goods returned within 30 days from the date the item(s)/product(s) are received. A refund will be given after inspection has been made and goods remain in new condition and are not damaged. If there is any visible shipping damage, Leafgreen Solutions LLC will notify you the buyer. Buyer is responsible for shipping damages and lost shipments until tracking number shows delivery to the address provided by Leafgreen Solutions LLC. All claims for this matter shall pass on to the buyer to be dealt with the carrier he/she has hired. Any shipping costs (including discounted or free shipping in some cases) incurred by Leafgreen Solutions LLC will be subtracted from the refund. If the buyer discovers that he/she has missing accessories that were purchased, the buyer must notify Leafgreen Solutions LLC within THREE business days.

ANY FREE/PROMO/ITEMS THAT WERE PART OF THE SALE OF RETURNED ITEM(S) MUST ALSO BE RETURNED.

We are unable to provide return shipping labels.

RE-STOCKING FEE

At sellers discretion, a re-stocking fee may be subtracted from your return. This often happens if the item is not in the same condition it was sent to you upon return or an item was canceled once it had already be prepared for shipment.

A Re-Stocking Fee may be up to 50% of the item price excluding shipping costs depending on item condition/shipment fulfillment position.

LIMITATION OF WARRANTY

Leafgreen Solutions LLC carries a 3 month warranty for defects due to faulty material and bad workmanship. Leafgreen Solutions LLC will repair or replace faulty goods and is not responsible for any consequential loss incurred due to faulty goods. Warranty does not cover normal wear, misuse or consumable items.

This Warranty shall not apply to any of such item(s)/product(s) which has been repaired or altered, except by the Seller Leafgreen Solutions LLC or which have been subjected to misuse, negligence, or accident.

Buyer further represents and acknowledges that Leafgreen Solutions LLC not be liable for incidental or consequential damages (Including strict liability in tort). Leafgreen Solutions LLC shall not be liable to Buyer, or any other party, for any loss, damage, injury or expense of any kind or nature caused directly or indirectly by the item/product or the failure of the item/product to operate properly.

SAFETY PRECAUTIONS

It is Buyer’s responsibility to provide all the means that may be necessary to effectively protect him/herself, all people and small children around the product from serious bodily injury. If Buyer fails to comply with such provisions of this paragraph or the applicable standards or regulations aforementioned, Buyer shall indemnify and hold Leafgreen Solutions LLC harmless from and against any and all claims, losses or damages arising there from. It is the responsibility of Buyer to comply with any and all local laws/codes. Leafgreen Solutions LLC will not be deemed responsible for any consequences to the buyer, such as allergic reactions or fails to satisfy the customers personal taste.

MAGNET WARNING

Extreme care must be exercised when using or handling magnets. Be careful to protect against pinching. Do not use sharp metal objects to open packaging; cutting utensils may get out of control if they are made of ferrous metals. The magnets listed on our website are much more powerful than many people imagine and need to be handled with extreme care. Rare earth magnets can be attracted to other magnets or metal objects from a distance of 18in (45cm) and can easily cause other serious injuries. Rare earth magnets that are allowed to snap together may chip and shatter causing small sharp pieces to become airborne. It is suggested to wear protective eyewear, and appropriate gloves when handling neodymium magnets. Always keep magnets away from Children and any sort of magnetic media storage device, including desktop or laptop computers, VHS tapes, iPod’s and credit cards. People with pacemakers must absolutely not be anywhere near a magnet let alone handle them. If you or someone in your household has a PACEMAKER, please ask your doctor about possible risks before purchasing any of our products/items with Magnets.

DESCRIPTIONS OF ITEMS/PRODUCTS AND SERVICES

All weights and measurements given are estimates, stated as correctly as possible, and any minor deviations shall not invalidate a sale. Brochures, photographs and other illustration representing the item(s)/Products(s) offered are not binding in detail, as improvements are constantly being made in design. Brochures and web site are subject to change without notice. If the item does not fit, you may return within our 30 day return period for a full refund minus shipping charges). You are responsible for shipping the item/product back to us.

ASSIGNMENT

This agreement may not be assigned without the express written consent of the parties hereto. Any attempted assignment of rights or delegation of duties shall be void.

GOVERNING LAW

This agreement shall be construed in accordance with the laws of the State of Iowa and will govern any disputes regarding the interpretation and or validity of these Terms and Conditions hereof. Any dispute relating to the item(s)/product(s) sold from Leafgreen Solutions LLC hereunder shall be subjected to the jurisdiction of the courts within Iowa. The provisions of this agreement are divisible and the invalidity or unenforceability of any provision or provisions contained herein shall not in any way affect the validity of this agreement without the invalid or unenforceable provision or provisions.

MERGER CLAUSES

The entire contract is embodied in this writing. There are no understandings, agreements, representations, or warranties, either oral or written, relative to the products, including statements made in or conduct implied from past dealings that are not fully expressed herein. No oral or any other form of statement subsequent to the acceptance of the sale purporting to modify the said terms and conditions shall be binding unless consented to in writing by a duly authorized officer of Leafgreen Solutions LLC in a document making specific reference to this transaction or after a transaction has been made.

LIMITATION OF LIABILITY

Leafgreen Solutions LLC will not be liable for any loss of profits, loss of income, loss of contracts, loss of data, damage, compensation for moral harm, costs, losses, lost turnover, or liabilities of any nature which may arise from the use of the website or 3rd Party Seller Accounts such as Ebay, Etsy or Amazon, it’s contents or manufactured products. Whether foreseen or unforeseen. Leafgreen Solutions LLC liability shall be limited to the total amount paid by the customer/buyer for their order.

INTELLECTUAL PROPERTY

All customers/buyers who send Leafgreen Solutions LLC an image, drawing or design (the “model”) guarantee that they are the author or holder of all intellectual property rights for this model and that they have not infringed any intellectual property rights by sending this model. You undertake to indemnify Leafgreen Solutions LLC against any claims by third parties. The customer/buyer) will retain ownership of the model sent to Leafgreen Solutions LLC. The customer/buyer grants Leafgreen Solutions LLC a license for the single use of their model to carry out their order.

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
